Privacy policy

1. Overview

This Privacy Policy outlines how Orpyx® Medical Technologies Inc. and affiliates (“Orpyx,” “we,” “us,” or “our”) collects, uses, and discloses personal information. It applies to www.orpyx.com, si-dashboard.orpyx.com, Orpyx technology including the Orpyx sensory insole (“Device”), the mobile application (the “App”), the data bridge (the “Hub”), the cloud-based health management system (“the Cloud”), and the dashboard healthcare providers use to monitor patients (the “Dashboard”), as well as any other services to which this Privacy Policy is linked (collectively, the “Services”).

Orpyx collaborates with healthcare providers to provide our services to patients who may benefit based on their health needs. This Privacy Policy does not apply to protected health information (“PHI”) that we process as a “business associate,” as those terms are defined under the Health Insurance Portability and Accountability Act of 1996, as amended, and regulations implemented thereunder (“HIPAA”). For information on how your PHI is used and disclosed in accordance with HIPAA, please ask your healthcare provider.  

Please read this Privacy Policy carefully. By using the Services you agree to the collection, use, and disclosure of your information as described in this Privacy Policy. If you do not agree to this Privacy Policy, please do not use or access the Services.

2. Understanding Orpyx Technology

The Orpyx Device is designed to monitor foot pressure and temperature, helping to prevent foot injuries in at-risk individuals. The Device captures pressure, foot temperature, mobility data, and other relevant patient data ("Patient Data") and transmits the Patient Data to the Hub or App. The Hub or App collects and may store this data, and the Hub sends the Patient Data to the Cloud for remote patient monitoring purposes via the Dashboard.

3. Collection of Personal Information

We collect personal information in the following situations:

  • When you complete our online forms
  • When an account is created for you with the information provided to Orpyx by your healthcare provider
  • When you contact us via email, phone, text, as part of an order for products or services, or other communication methods
  • When you request information or assistance through the Services
  • When Patient Data is collected and transmitted
  • When your healthcare provider shares your health data with Orpyx, such as when your healthcare provider sends prescription details or other relevant health information associated with your care plan or medical history
  • When you subscribe to Orpyx newsletters, attend Orpyx webinars, or purchase Orpyx products/services
  • When you create a candidate profile in our job applicant tracking system.

Personal information collected may include:

  • Name, email, username, password, address, phone number, date of birth, insurance details
  • Information related to your treating physician or healthcare facility
  • Any other details you provide in your profile or communications to Orpyx
  • Patient Data
  • Applicant details such as information included in your resume or CV, references, and job history.

When using the Services, we may collect technical data about your use including via cookies and other tracking technologies, such as:

  • Device type, operating system, software version number, IP address
  • A unique identifier (such as your mobile device IMEI number, MAC address of the wireless network interface serial number, or phone number)
  • Usage data (e.g., meter errors, log files)
  • Location data, country, language code and time zone settings
  • Analytic data (e.g., usage statistics, data on links clicked, websites visited before or after you visit, pages viewed, time spent on each page)
  • Technical information about related software, hardware and peripherals
  • Date and time information is collected or transmitted.

4. Use of Personal Information

We use personal information for purposes such as:

  • Providing Orpyx Services, including products and services such as the Device, App, Hub, and cloud-based health management tools
  • Providing customer support
  • Assisting in your treatment, providing insights to your healthcare providers
  • Improving and testing the functionality of our Services
  • Ensuring the security and performance of our Services
  • Analyzing data and conducting research
  • Communicating with you about reminders, updates, informational surveys, or product recommendations
  • Conducting marketing, advertising, and promotional activities
  • Determining and improving the effectiveness of disease management techniques, therapies, treatments and costs.

In addition to the specific uses described above, we may use any of the above information to maintain our business relationship, send service and other non-marketing communications, monitor and analyze trends, conduct internal research and development, comply with applicable legal obligations, enforce any applicable terms of service, and protect the Services, our rights, and the rights of our employees, users / patients, or other individuals.

We may also use statistical, aggregated, or anonymized data for any purpose to the extent permitted by applicable laws, including product development or research purposes (including case studies, white papers, journal publications, etc.). We do not sell this data for money.

Marketing

You can opt out of marketing at any time by contacting us at info@orpyx.com or using the unsubscribe link in our marketing communications. We will continue to send you non-marketing information, such as updates or safety notifications if applicable. No mobile information will be shared with third parties or affiliates for marketing or other promotional purposes.  All other categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties. 

5. Disclosure of Personal Information

We may share your personal information with:

  • Your healthcare provider
  • Service providers, such as those who help us deliver Orpyx products and services to you and for onboarding, testing, development, support, and maintenance of our Services and services
  • Researchers, including to evaluate or improve the performance of our Services and technology or disease management techniques/therapies/treatment
  • Companies involved in marketing and customer outreach
  • Credit card processors and billing services, for payment processing, if applicable
  • Prospective buyers in the event of a business sale, merger, acquisition, or other business transaction, including in the context of a bankruptcy
  • Distributors and selected partners

We may also disclose your information as needed to comply with applicable law or any obligations thereunder or to cooperate with law enforcement, judicial orders, and regulatory inquiries, to enforce any applicable terms of service, and to ensure the safety and security of our business, employees, and users / patients.

6. Storage and Retention

Personal information is stored in Canada or the U.S. and may be subject to local laws, which may grant government or security authorities access in certain cases. Orpyx retains personal information until:

  • We no longer need the information for the purpose(s) it was collected;
  • All legal requirements related to the data, including legal retention periods, have been fulfilled
  • You ask us to delete the data. Note that if we require the data to fulfill certain business functions, or to comply with law, we are not able to delete the data even if you ask us to.

Orpyx uses certain organizational, administrative, technical, and physical safeguards to protect your personal information from unauthorized access or loss. Despite our reasonable efforts to protect your information, no security measures are impenetrable, and we cannot guarantee “perfect security.” Any information you send to us electronically, while using the Services or otherwise interacting with us, may not be secure while in transit. We recommend that you do not use unsecure channels to send us sensitive or confidential information.

Moreover, you are responsible for securing the device you use to access or visit our Services. Additionally, if you choose to register an account, you are responsible for keeping your account credentials safe. We recommend you do not share your access details with anyone else. Contact us immediately if you suspect unauthorized access or that your account has been compromised.

7. Cookies and Tracking Technologies

We use cookies to track activity and improve user experience. Most browsers accept cookies automatically, but you may be able to adjust your browser settings to block cookies. However, some features of the Services may not function without them. Your browser settings may allow you to transmit a “do not track” signal, “opt-out preference” signal, or other mechanism for exercising your choice regarding the collection of your information when you visit various websites. Like many websites, our website is not designed to respond to such signals, and we do not use or disclose your information in any way that would legally require us to recognize opt-out preference signals.

8. Children's Privacy

Our Sites are not intended for children under 13. We do not knowingly collect information from children under 13.  If you believe we have collected such information, please contact us to remove it.

9. Changes to Policies

We may update this document periodically, in which case we will update the “Last Updated” data at the bottom of this Privacy Policy. If we make material changes to the way in which we use or disclose information we collect, we will use reasonable efforts to notify you (such as by emailing you at the last email address you provided us, by posting notice of such changes on the Services, or by other means consistent with applicable law) and will take additional steps as required by applicable law.  If you do not agree to any updates to this Privacy Policy, please do not continue using or accessing the Services.
